Copyright Protection Afforded Open Source Licensing

Jan Novak, Associate Director jan.novak@law.csuohio.edu | August 19, 2008 - 08:52

In Jacobsen v. Katzer (No. 2008-1001, Aug 13, 2008) the United States Court of Appeals for the Federal Circuit ruled that open source or free ware licenses are entitled to copyright protection, recognizing economic rights in the granting of a public license regardless of the absence of money exchanged. See O'Reilly Radar's Roberta Caimey, Landmark Case Upholds Open Source Licenses for an analysis on the import of this decision for the open source and collaborative contributor movements.
